Subject And Scope Of The Agreement
This Distance Sales Agreement ("Agreement") Has Been Drawn Up İn Accordance With Consumer Protection Law No. 6502 ("Law") And The Distance Contracts Regulation. The Parties To This Agreement Acknowledge And Declare That They Are Aware Of And Understand Their Obligations And Responsibilities Arising From The Law And The Distance Contracts Regulation Under This Agreement.
The Subject Of This Agreement İs To Determine The Rights And Obligations Of The Parties, İn Accordance With The Provisions Of The Law And The Distance Contracts Regulation, Regarding The Sale And Delivery Of Goods Or Services Specified İn The Agreement, Which The Buyer Electronically Orders Through The Www.İstanbulofismobilya.Com.Tr Website (The "Website"), Owned By Istanbul Ofis Mobilya ("Istanbul Ofis/Intermediary Service Provider").
The Execution Of This Agreement Shall Not Preclude The Performance Of The Provisions Of The Website Membership Agreements Executed By The Parties Separately With Istanbul Ofis Mobilya. The Parties Acknowledge And Declare That Istanbul Ofis Mobilya İs Not A Party To The Sale Of The Goods Or Services Subject To This Agreement And Has No Liability Or Commitment Regarding The Fulfillment Of The Parties' Obligations Under This Agreement.

The Product Prıce In Questıon Is Collected From The Buyer By The Istanbul Offıce On Behalf Of The Seller Under The Payment Protectıon System. By Payıng The Prıce For The Goods/Servıces To Istanbul Offıce, The Buyer Wıll Be Consıdered To Have Paıd The Prıce For The Product To The Seller.

Delıvery And Delıvery Method Of The Goods
The Contract Enters İnto Force Upon Electronic Confirmation By The Buyer And İs Fulfilled Upon Delivery To The Buyer Of The Goods Or Services Purchased From The Seller. The Goods Will Be Delivered To The Address And Authorized Person(S) Specified By The Buyer On The Order Form And İn This Contract.

Delıvery Costs And Performance
Unless Otherwise Stipulated, The Delivery Costs Of The Goods Are The Responsibility Of The Buyer. If The Seller Has Declared On The Website That They Will Cover The Delivery Costs, The Delivery Costs Will Be The Responsibility Of The Seller.
Delivery Of The Goods Will Be Made Within The Promised Timeframe Following Payment. The Seller Shall Deliver The Goods Or Services Within 30 (Thirty) Days Of The Buyer'S Order, Save For Cases Where The Fulfillment Of The Ordered Goods Or Services Becomes İmpossible.
If, For Any Reason, The Buyer Does Not Pay For The Goods Or Services, Or İf The Payment İs Cancelled İn The Bank Records, The Seller İs Deemed To Be Relieved Of İts Obligation To Deliver The Goods Or Services.
If The Buyer Cancels The Order After The Goods Have Been Shipped By The Seller But Before The Buyer Receives Them, The Buyer İs Responsible For The Shipping Costs.

If The Fulfillment Of The Ordered Goods Or Services Becomes İmpossible, The Seller Shall Notify The Buyer Within 3 (Three) Days Of Learning Of This Situation And Shall Refund All Payments Received, İncluding Any Delivery Costs, Within 14 (Fourteen) Days Of The Notification Date.

Buyer'S Declaratıons And Warrantıes
The Buyer Declares That They Have Read And Are Aware Of The Preliminary İnformation Uploaded By The Seller Regarding The Basic Characteristics, Sales Price, Payment Method, And Delivery And Shipping Costs Of The Goods Or Services Subject To This Agreement, Which Are Available On The Website, And That They Have Provided The Necessary Confirmation Electronically.
Buyers, As Consumers, May Submit Their Requests And Complaints Using The Seller'S Contact İnformation Above And/Or Through The Form On The Website.
By Electronically Confirming This Agreement And The Preliminary Information Form, The Buyer Confirms That They Have Obtained The Correct And Complete İnformation Regarding The Address, Basic Specifications Of The Ordered Goods Or Services, The Price Of The Goods Or Services İncluding Taxes, Payment, Delivery, And Delivery Price, Which Should Be Provided To The Buyer By The Seller Before The Conclusion Of Distance Contracts. If The Buyer Receives Goods Or Services Subject To This Agreement From The Courier Company That Are Clearly Damaged Or Defective, Such As Damaged, Broken, With Torn Packaging, Etc., Upon Delivery, The Buyer İs Entirely Responsible.
If, After Delivery Of The Goods Or Services, The Relevant Bank Or Financial İnstitution Fails To Pay The Seller The Price Of The Goods Or Services Due To The Unfair Or Unlawful Use Of The Buyer'S Credit Card By Unauthorized Persons Not Due To The Buyer'S Fault, The Buyer İs Obligated To Return The Goods Or Services To The Seller Within Three (3) Days, Provided They Have Been Delivered To The Buyer. In Such Cases, The Delivery Costs Will Be The Responsibility Of The Buyer.

Seller'S Declaratıons And Warrantıes
The Seller İs Responsible For Delivering The Goods Or Services Subject To The Contract To The Buyer İn Accordance With Consumer Legislation, İn Good Condition, Complete, And İn Accordance With The Specifications Specified İn The Order, And Accompanied By Any Warranty Documents And User Manuals.

If The Seller İs Unable To Deliver The Goods Or Services Subject To The Contract Within The Specified Time Due To Force Majeure Or Extraordinary Circumstances Preventing Transportation, The Seller İs Obligated To Notify The Buyer Within Three (3) Days Of Learning Of The Situation.

If The Goods Or Services Subject To The Contract Are To Be Delivered To A Person Other Than The Buyer, The Seller Cannot Be Held Responsible İf The Recipient Refuses To Accept The Delivery.

Rıght Of Wıthdrawal
The Buyer May Exercise Their Right Of Withdrawal Within 14 (Fourteen) Days From The Date Of Delivery For Transactions Related To The Sale Of Goods, And Within 14 (Fourteen) Days From The Date Of Purchase For Transactions Related To The Sale Of Services, Without Assuming Any Legal Or Criminal Liability And Without Providing Any Justification. The Buyer May Also Exercise Their Right Of Withdrawal Within The Period Until The Delivery Of The Goods.
The Buyer Must Exercise Their Right Of Withdrawal By Logging İnto İstanbulofismobilya.Com.Tr And Clicking The "Return" Link On The Form Provided On İstanbulofismobilya.Com.Tr. The Buyer Must Complete The Return Request Form On The Relevant Page, Obtain The Seller'S Return Address İnformation, And Return The Goods Within 10 (Ten) Days From The Date Of Exercising Their Right Of Withdrawal. The Goods Must Be Returned Complete And Undamaged, Along With The İnvoice, The Goods' Box, Packaging, Any Standard Accessories, And Any Other Gifts Provided With The Goods. The Buyer İs Not Responsible For Any Changes Or Deterioration That Occur During The Withdrawal Period, Provided The Goods Are Used İn Accordance With Their Operation, Technical Specifications, And Usage İnstructions.

As Long As The Buyer Sends The Returned Goods To The Seller Using The Seller'S Contracted Courier Company Specified İn The Preliminary Information Form, The Return Shipping Cost İs The Seller'S Responsibility. If The Buyer Sends The Returned Goods Using A Courier Company Other Than The Seller'S Contracted Courier Company Specified İn The Preliminary Information Form, The Seller İs Not Responsible For The Return Shipping Cost Or Any Damage To The Goods İncurred During The Shipping Process.

Within 14 (Fourteen) Days Of The Buyer Exercising Their Right Of Withdrawal (Provided The Goods Are Returned Via The Carrier Specified By The Seller For Return), All Payments Made By The Buyer To The Seller Or Intermediary Service Provider For The Relevant Goods Or Services Will Be Refunded To The Buyer İn A Single Lump Sum, İn Accordance With The Payment Method Used At The Time Of Purchase, Without Any Cost Or Liability To The Consumer. For Purchases Made Using Credit, İf The Right Of Withdrawal İs Exercised Properly, The Product Price Will Be Refunded To The Account Associated With The Credit.

Cases In Whıch The Rıght Of Wıthdrawal Cannot Be Exercısed
According To Legislation, The Buyer Cannot Exercise The Right Of Withdrawal İn The Following Cases:
• Products Specifically Prepared According To The Buyer'S Wishes Or Clearly İn Line With Their Personal Needs, And Which Are Not Suitable For Return Due To Their Nature; Goods Whose Protective Elements Such As Packaging, Tape, Seals, Or Packages Have Been Opened After Delivery; Contracts For The Delivery Of İtems That Are Not Suitable For Return Due To Health And Hygiene Reasons; Contracts For Services Whose Performance Begins With The Consumer'S Consent Before The Expiration Of The Right Of Withdrawal Period; And Contracts For Services Performed İnstantly Electronically And İntangible Goods Delivered İmmediately To The Consumer (Gift Cards, Gift Certificates, Coupons That Replace Cash, Etc.).

• Returns Cannot Be Accepted For Products That Have Been İnstalled.

Dıspute Resolutıon
Under The Law And The Distance Contracts Regulation, The Seller İs Solely Responsible For The Goods Or Services Sold. However, Buyers Are Encouraged To Submit Their Complaints Regarding The Goods And Services They Purchased To The Sellers Directly Or Through The Istanbul Office. If The Complaint İs Forwarded To The Istanbul Office, The Istanbul Office Will Provide All Possible Support To Resolve The İssue.

In Disputes Arising From This Distance Selling Agreement, The Provincial Or District Consumer Problems Arbitration Committees İn The Buyer'S Place Of Residence Or The Place Where The Product Was Purchased, Up To The Value Declared Annually By The Ministry Of Customs And Trade, Shall Have Jurisdiction. For Disputes Exceeding This Value, The Consumer Courts Shall Have Jurisdiction.

Prıce Of The Goods/Servıces
The Cash Or Deferred Sales Price Of The Goods İs The Price İncluded İn The Order Form, The Notification Email Sent After The Order, And The İnvoice Sent To The Customer Along With The Product. Discounts, Coupons, Shipping Fees, And Other Practices Applied By The Seller Or The Istanbul Office Shall Be Reflected İn The Sales Price.

Default And Legal Consequences
If The Buyer Defaults On Credit Card Transactions, The Cardholder Shall Pay İnterest And Be Liable To The Bank İn Accordance With The Credit Card Agreement Entered İnto With The Bank. In This Case, The Relevant Bank May Take Legal Action; İt May Claim The Resulting Costs And Attorney Fees From The Buyer. Under Any Circumstances, İf The Buyer Defaults On İts Debt, The Buyer Will Be Responsible For Any Losses And Damages İncurred By The Seller Due To The Buyer'S Delayed Performance.

Notıfıcatıons And Evıdence Agreement
All Correspondence Between The Parties Under This Agreement Will Be Made Through The My Account > Product Questions Section Of The Website Or Via E-Mail, Except İn Cases Of Necessity As Stipulated İn Legislation. The Buyer Acknowledges, Declares, And Undertakes That, İn Any Disputes Arising From This Agreement, The Official Books And Commercial Records Of The Seller And The Istanbul Office, As Well As The Electronic İnformation And Computer Records Held İn İts Database And Servers, Will Constitute Binding, Definitive, And Exclusive Evidence, And That This Article Constitutes An Evidence Agreement Within The Meaning Of Article 193 Of The Code Of Civil Procedure.
Enforcement
This Agreement, Consisting Of 14 (Fourteen) Articles, Has Been Read By The Parties And Electronically Approved By The Buyer, And Has Entered İnto Force On .
